Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Echo Rank platform, including the websites at echorank.ai and app.echorank.ai, as well as all related services, features, and content (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1. Definitions

  • "Echo Rank" (also "we," "our," or "us") refers to the company operating the Service.
  • "User" (also "you" or "your") refers to any individual or entity that accesses or uses the Service.
  • "Service" refers to the Echo Rank Generative Engine Optimization platform, including all features such as AI citation tracking, content analysis, competitor monitoring, and optimization scoring.
  • "Content" refers to all data, text, reports, analyses, and other materials generated by or through the Service.

2. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We use Clerk for authentication. By creating an account, you also agree to Clerk's terms of service as applicable to end users. You may sign in using email, Google, or other supported OAuth providers.

3. Service Description

Echo Rank is a Generative Engine Optimization (GEO) platform that helps you track and improve your brand's visibility in AI-powered search engines and assistants. The Service includes:

  • AI citation tracking across ChatGPT, Claude, Perplexity, Gemini, AI Overviews, and Copilot
  • Content performance scoring and optimization recommendations
  • Competitor analysis and benchmarking
  • Reporting and alerts including weekly summaries and real-time notifications

AI citation data is collected by querying third-party AI platforms. Results may vary based on the behavior and availability of these third-party services, which are outside our control.

4. Subscriptions and Billing

4.1 Plans and Pricing

The Service is offered under various subscription plans as described on our pricing page. Features, usage limits, and pricing are subject to change with reasonable notice. We may offer a free trial period for new accounts.

4.2 Payment Processing

Payments are processed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selected plan). All fees are stated in US dollars unless otherwise indicated.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You retain access to paid features until the end of the current billing period
  • Your account will revert to the free tier (if available) or become inactive
  • No prorated refunds are issued for partial billing periods

Refund requests for exceptional circumstances may be submitted to support@echorank.ai and will be reviewed on a case-by-case basis.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Submit domains or content that you do not have the right to monitor or analyze
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Circumvent usage limits, rate limits, or access controls
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure
  • Use automated scripts, bots, or scraping tools to access the Service beyond the provided API, if any
  • Resell, sublicense, or redistribute the Service or its data without our prior written consent
  • Use the Service to generate spam, misleading content, or engage in deceptive practices

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

6. Intellectual Property

6.1 Our Property

The Service, including its design, software, algorithms, scoring methodologies, branding, and documentation, is owned by Echo Rank and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

6.2 Your Data

You retain all rights to the data you submit to the Service (domains, queries, and related business information). You grant us a limited, non-exclusive license to use this data solely to provide and improve the Service. We will not sell your data to third parties.

6.3 Generated Reports

Reports, scores, and analyses generated by the Service are provided for your use. You may share and use these outputs in your business operations. However, the underlying methodology and algorithms used to generate them remain our intellectual property.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.

8. Third-Party Services and AI Platforms

The Service relies on third-party AI platforms (including OpenAI, Anthropic, Google AI, and others) to provide citation tracking and analysis. We are not responsible for:

  • The accuracy, availability, or completeness of data returned by third-party AI platforms
  • Changes to third-party APIs, terms, or policies that may affect the Service
  • Temporary outages or disruptions in third-party services

AI-generated citation data is inherently variable. Results may differ between queries and over time. We present this data as-is and do not guarantee specific outcomes or rankings.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI CITATION DATA AND OPTIMIZATION SCORES ARE PROVIDED FOR INFORMATIONAL PURPOSES AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR BUSINESS DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECHO RANK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Echo Rank, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account and access to the Service at any time if:

  • You breach any provision of these Terms
  • We are required to do so by law
  • We discontinue the Service or any material part of it

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

You may request an export of your data within 30 days of termination by contacting support@echorank.ai.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Echo Rank is incorporated, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

14. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page, updating the "Last updated" date, and, where appropriate, notifying you by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Echo Rank regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent.
